By accessing or using Probly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Probly provides trading signals, market analysis, educational content, and access to a private community through a monthly subscription service. Our service includes:

  • Access to automated trading signals
  • Weekly market briefs and analysis
  • Private Discord community access
  • Educational resources and support

Important: Our service provides trading signals and educational content only. We do not provide financial, investment, or trading advice. All trading decisions are your own responsibility.

3. Subscription and Payment

3.1 Subscription Terms

  • Subscriptions are billed monthly at $27.00 USD
  • Subscriptions automatically renew each month unless canceled
  • You may cancel your subscription at any time through your account settings or by contacting support
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial billing periods

3.2 Payment Processing

Payments are processed through Stripe. By subscribing, you agree to Stripe's Terms of Service. You are responsible for providing accurate payment information and maintaining valid payment methods.

3.3 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated to existing subscribers with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new price.

4. User Accounts

  • You must be at least 18 years old to use the Service
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate, current, and complete information during registration
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Share, distribute, or resell our trading signals, content, or community access
  • Attempt to reverse engineer, decompile, or extract our trading algorithms or methods
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate any person or entity or falsely state your affiliation with any person or entity
  • Harass, abuse, or harm other community members
  • Violate any applicable laws or regulations in your jurisdiction

6. Risk Disclaimer

TRADING INVOLVES SUBSTANTIAL RISK OF LOSS.

  • Risk of Loss: You may lose some or all of your invested capital. Only trade with money you can afford to lose.

  • Individual Results: Results vary significantly by individual. Success stories shared on our website are not typical and should not be expected by all members.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Probly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our content without our express written permission.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Breach of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Sharing or reselling our content or signals
  • Non-payment of subscription fees

Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time, and termination will take effect at the end of your current billing period.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any trading losses you incur
  • Any unauthorized access to or use of our servers or your personal information
  • Any errors or omissions in any content
  • Any interruption or cessation of transmission to or from the Service

10. Indemnification

You agree to defend, indemnify, and hold harmless Probly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

11. Compliance with Laws

You are responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and rules in your jurisdiction. This includes, but is not limited to, laws regarding trading, gambling, securities, and financial services. We do not provide legal advice and make no representations about the legality of trading activities in any jurisdiction.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
